After deliberating for about six and a half hours, a jury found Saskatoon nightclub owner Skipp Anderson guilty of sexual assault.

The issue for the jury was whether sex between Anderson and one of his friends after a hot tub party two summers ago was consensual.

Deliberations began Thursday afternoon at Saskatoon Court of Queen’s Bench. The verdict came down shortly before 9 p.m.

In his charge to the jury earlier in the day, Justice Ronald Mills told jurors the case is about consent — a voluntary agreement to engage in sexual activity.

Mills said if the jury found the complainant did not consent, or was incapable of consenting to sexual activity due to intoxication, then they had to find Anderson guilty of sexual assault. However, if jurors believed the complainant did consent, or that Anderson had an honest but mistaken belief of consent, then they had to acquit Anderson.

Former Saskatoon nightclub owner Skipp Anderson was sentenced Tuesday to 30 months in a federal institution for a sexual assault the Crown called “opportunistic.”. In January, a jury found Anderson , 41, guilty of sexually assaulting a man who was a friend of his at the time.

Following the verdict, Mills told the jury to never discuss the reasons for their verdict outside of the jury room. After the jury was dismissed, the case was adjourned to Friday morning for discussions about sentencing.

Crown prosecutor Tamara Rock said outside court the sentencing range for a major sexual assault starts at three years.

She said the complainant is relieved and grateful for the jury’s verdict.

“This was a hard factual case; it had a major memory loss due to intoxication. But I see that society is being more and more receptive to the voices of people who have experienced sexual violence and I think that this is reflected in this decision and it’s a very encouraging decision,” Rock said.

“We had a very brave and strong complainant in the case. Regardless of the verdict I was so pleased that his voice could be heard and I’m hopeful that his experience will allow people who have experienced sexual violence to come forward.”

In her closing arguments, Rock argued the complainant, a then 22-year-old friend of Anderson’s, was too intoxicated to consent to sex on July 11, 2016. Rock questioned how the man could consent, pointing to evidence that he was too drunk to hold himself above the hot tub water and had to be removed.

Anderson testified he knew the man was intoxicated because he helped put him into a spare bedroom.

Friends testified that the complainant was touching and kissing Anderson in the hot tub earlier that night. On the stand, Anderson admitted that he became aroused.

Common sense would show Anderson got into bed the next morning with the man, who was either sleeping or passed out, because he wanted to have sex with him, Rock told the jury.

Defence lawyer Brad Mitchell argued the sexual activity between Anderson and the complainant was consensual. He said although Anderson admitted being extremely intoxicated earlier in the night, there is no evidence that suggests he was too drunk to comprehend the complainant’s level of intoxication later that morning.

Mitchell also said the complainant’s level of intoxication could have changed in the three-hour span between the time he was removed from the hot tub and when Anderson came into the bed.

The complainant testified that he blacked out in the hot tub and does not remember consenting to having sex. He said he awoke to being anally penetrated by Anderson and told him to stop.

However, Mitchell argued it was the complainant who initiated the sex and actively engaged by getting on top of Anderson.

Mitchell said Anderson had to obtain consent in order to have anal sex because without lubricant, the nature of the act itself could result in injury. Rock argued Anderson was not concerned for the man’s well-being because he chose not to use a lubricant and didn’t wear a condom.

Justice Mills reminded jurors that the complainant’s conduct after the alleged assault should not be used to convict or acquit, and that jurors should not make assumptions about the case based on the sexual orientation of the people involved.
